Biography:Keith E. Kopplin’s practice focuses on employment litigation and employment law matters.

Keith assists clients in resolving wage and hour class and collective actions, defending employment discrimination claims, responding to government audits, and improving workplace policies and procedures. He also provides day-to-day counseling to employers regarding a wide range of human resource matters including discipline and discharge decisions, the Wisconsin and federal Family and Medical Leave Acts, wage and hour practices, and workplace accommodations.

Keith strives to find creative and cost-effective solutions to some of the most vexing workplace issues, including Family and Medical Leave Act abuse, incidents of off-the-clock work, and reasonable accommodation requests. He has given presentations on numerous topics, including the use of social media by employees, Wisconsin’s concealed carry law, employee handbooks, workplace violence, employee privacy, the hiring process, the Wisconsin and federal Family and Medical Leave Acts, discipline and discharge, and unemployment insurance. Keith also presents customized training programs for employers.

Program Overview:There has been a burst of litigation under the federal Fair Labor Standards Act, and Wisconsin’s Wage Payments Act. The issue is whether all employee activity, within the workplace, required by the employer, must be treated as “work” for which compensation must be paid.

Employees are entitled to a 150% premium paid on their contract wage rate, for hours of work in excess of 40 hours in a work week – “overtime” compensation.

The presentation will summarize outcomes in recent overtime litigation and related litigation entailing a determination of when unpaid lunch breaks are “work” for which compensation must be paid.

The presentation will focus on design, organization and management of on-the-ground production processes so that the non-compensated, but required conduct, is not “integral and indispensable to performance of the employees “principal” production activity.

The presentation will also discuss the use of experts who can validly measure the time spent in the contested activity. This metric is important to issues of liability, as well as to issues of damages.
Learning Objective 1:Participants will learn the model of analysis federal and Wisconsin courts utilize when determining whether particular activities required by an employer, but not compensated, are or are not “integral and indispensable” to the performance of employee’s “principal activity.”
Learning Objective 2:Participants will learn how to engage in cooperative discussions between HR and operational people on the design, organization and management of the work process so that certain required activities for which compensation is not paid are likely to be deemed not “integral and indispensable” to the employee’s “principal activity.”
Learning Objective 3:Participants should also learn how to use experts to validly determine the time spent in the contested activities. This metric is relevant to the determination of damages, assuming liability. The metric is also relevant the employer’s position that the time involved is so trivial that the violation, if any, is de minimis and no monetary liability attaches.

Co-Presenter Biography:David F. Loeffler has been practicing law since 1963. The emphasis of his practice is in general labor and employment litigation, and white-collar criminal defense.

He argued successfully to the District of Columbia Court of Appeals that it was not a violation of the NLRA to discharge an employee believed by the employer to have engaged in boycott activities; to the Seventh Circuit Court of Appeals that an arbitrator exceeded his authority when he determined that a collective bargaining agreement contained external law and that the employer violated external law; and to the NLRB that all communication between counsel and client in the collective bargaining context is subject to attorney-client privilege.

David is the author of a chapter on Union-Management Relations in the State Bar of Wisconsin publication, Labor and Employment Law in Wisconsin and several newspaper articles: “Worker Replacement as a Moral Issue,” The Wall Street Journal, August 5, 1991 and “Repeal of the Targeted Jobs Credit Would Harm the Least Well-Off,” The Milwaukee Journal, June 3, 1987.

He is admitted to practice in Wisconsin and Michigan and before the U.S. Courts of Appeals for the Second, Sixth, Seventh and Eighth Circuits, the District of Columbia, and the U.S. Supreme Court.

David was a professor of law at Wayne State University in Michigan and at Florida State University. He was a law clerk to Justice Horace Wilkes at the Wisconsin Supreme Court.
